This Membership Agreement and Facility Access Terms (“Agreement”) is entered into between Green Bird Golf LLC (“Green Bird”) and the undersigned member (“Member”). By purchasing, activating, or using a Green Bird membership, Member acknowledges that they have read, understood, and agree to be bound by this Agreement.
Members must be at least 18 years of age for independent facility access. Members aged 15–17 may hold a membership only with parental/guardian authorization (an active member) and must be accompanied by an authorized adult while on premises. Green Bird may request proof of age or identity at any time.
Access privileges depend on the Member’s selected tier. Credentials (key cards, mobile credentials, access codes) are personal and non-transferable; sharing, tailgating, or circumventing access controls may result in immediate suspension or termination. Green Bird may modify hours, access procedures, and benefits at any time.
Members may use the facility with other active members at any time, subject to capacity and reservation rules. Non-member guests are permitted only during staffed hours, subject to bay capacity and facility rules. Guests are strictly prohibited during unstaffed hours, and Members may not grant access to non-members at those times. Members are fully responsible for their guests’ conduct, damages, and violations, and Green Bird may deny access, remove guests, or suspend/terminate memberships for guest policy violations.
Members and guests must behave respectfully and safely. Strictly prohibited: theft, vandalism, harassment, discrimination, threats, fighting, illegal activity or substances, unauthorized access to restricted areas, and tampering with equipment or security systems. Green Bird may remove, suspend, or terminate any Member for conduct it deems unsafe, disruptive, unlawful, or detrimental to the facility, staff, guests, or other Members.
No outside food, beverages, or alcohol are permitted on Green Bird property. Alcohol consumption is strictly prohibited during unstaffed hours, and all alcohol must be consumed or discarded before unstaffed hours begin. Green Bird may refuse entry to or remove anyone who appears intoxicated, impaired, disruptive, or unsafe. Members must follow all posted rules and staff directives, and must immediately report any injury, damage, malfunction, or unsafe condition — failure to report may constitute a violation of this Agreement.
Members and guests must use facility equipment responsibly and only as intended. They may not move, unplug, alter, or tamper with simulators, screens, monitors, cameras, projectors, computers, or networking equipment; modify simulator settings beyond normal use; use equipment recklessly; or swing clubs outside designated hitting areas. Members are responsible for ensuring guest compliance. Green Bird may restrict equipment or facility access for maintenance, repairs, safety, or operational reasons.
Members are financially responsible for any loss, theft, damage, or misuse of Green Bird property (including simulators, screens, monitors, projectors, computers, cameras, furniture, golf equipment, doors/access systems, and building fixtures) caused by themselves or their guests. Damage, malfunctions, or accidents must be reported immediately. Theft, attempted theft, or intentional destruction results in immediate termination without refund and may be referred to law enforcement. Green Bird may charge the Member’s payment method on file for verified damages, repairs, replacement, labor, and administrative costs.
Members must leave bays, seating areas, restrooms, and common areas clean and orderly, and dispose of trash and personal items in designated receptacles. Green Bird may charge reasonable cleaning or restoration fees for excessive messes, vandalism, or extraordinary cleaning needs; normal use does not result in cleaning fees.
Green Bird uses video surveillance, access control, reservation records, and monitoring systems for safety, security, and investigative purposes. All areas except restrooms may be recorded 24/7. This data may be used to investigate incidents, determine responsibility, and enforce this Agreement. Members consent to such monitoring while on Green Bird property.
Green Bird is not responsible for lost, stolen, misplaced, or damaged personal property — Members are solely responsible for securing their belongings. Items left for more than 30 days may be discarded, donated, or disposed of without compensation.
Members must comply with current and future reservation policies, facility rules, and membership guidelines, which may be modified by Green Bird without amending this Agreement. Repeated no-shows, reservation abuse, or policy violations may result in warnings, booking restrictions, suspension, or termination. Green Bird may temporarily suspend access for maintenance, repairs, emergencies, private events, weather, or operational needs.
Member acknowledges that golf activities, simulator use, and facility use involve inherent risks that cannot be eliminated, including golf balls striking persons or property, deflected/ricocheting balls, equipment failure, slips/trips/falls, physical exertion, contact with other participants, and accidents during entry, exit, or use of the facility. Member voluntarily assumes all such risks and acknowledges that participation is entirely voluntary and safety cannot be guaranteed.
To the fullest extent permitted by law, Member releases, waives, and covenants not to sue Green Bird Golf & Entertainment and its owners, officers, employees, affiliates, contractors, agents, landlords, successors, and assigns from any claims arising from use of the facility, golf activities, simulator equipment, actions of other members/guests, property damage, personal injury, illness, or death — whether known or unknown, foreseen or unforeseen, except where prohibited by law.
Member agrees to defend, indemnify, and hold harmless the Released Parties from claims, damages, losses, and expenses (including attorneys’ fees) arising from the Member’s or their guests’ actions, violations of this Agreement, property damage, personal injury, or unauthorized access granted by the Member. This obligation survives termination of membership.
Member authorizes Green Bird to charge the payment method on file for membership dues, taxes, guest fees, property damage, cleaning/restoration fees, unpaid balances, returned payment fees, administrative fees, and any other authorized charges. Members must keep billing information current; invalid payment info or delinquent accounts may result in suspension or termination of access.
Membership is a privilege, not a right. Green Bird may suspend, restrict, or terminate membership at its sole discretion to protect safety, security, operations, property, staff, guests, or members — including for theft, property damage, unauthorized access or credential sharing, guest violations, reservation abuse, harassment, illegal activity, safety violations, fraud, non-payment, or any policy violation. Terminated memberships are not entitled to refunds unless required by law.
This Agreement is governed by the laws of the State of Texas. Disputes shall be brought exclusively in Denton County, Texas, unless otherwise required by law. If any provision is invalid, the remainder stays in full force. Green Bird’s failure to enforce any provision does not waive its right to do so later.
By purchasing, activating, or using a Green Bird membership, Member acknowledges that they have read, understood, and agree to be bound by this Agreement.
